Partner (Spouse) visa

    This visa enables the spouse or partner of an eligible New Zealander, an Australian permanent resident, or an Australian citizen to reside in Australia.

    The 309 temporary visa is a temporary visa, while the 100 immigrant visa is a permanent visa. First, a 309 temporary visa will be issued. This allows applicants to stay in Australia for two years and apply for an immigrant 100 visa within that period.

    Both the temporary and permanent partner visas are applied for simultaneously.


    • 309 visa: Also known as a Partner (Provisional) visa, this visa is for individuals who are in a relationship with an Australian citizen, permanent resident or eligible New Zealand citizen and are outside Australia.
    • 100 visa: Also known as a Partner (Migrant) visa, this visa is for individuals who are in a relationship with an Australian citizen, permanent resident or eligible New Zealand citizen and are inside Australia.

    • Must be in a genuine and ongoing relationship with an Australian citizen, permanent resident or eligible New Zealand citizen.
    • Must meet certain health and character requirements.
    • Must provide sufficient evidence of the relationship and financial interdependence.

    Benefits

    • The holder of the 309 visa can apply for the 100 visa after two years if the relationship with their partner is still ongoing.
