Partner (Spouse) visa

    The 820 and 801 visas are Onshore Partner visas issued by the Australian government. After been awarded the temporary Partner visa (subclass 820), which allows you to remain in Australia for up to 24 months, you may be eligible for the permanent Partner visa (subclass 801).


    • 820 visa: Also known as a Partner (Provisional) visa, this visa is for individuals who are in a relationship with an Australian citizen, permanent resident or eligible New Zealand citizen.
    • 801 visa: Also known as a Partner (Permanent) visa, this visa is for individuals who are in a relationship with an Australian citizen, permanent resident or eligible New Zealand citizen and have held a Provisional Partner visa for at least two years. This visa allows the holder to live and work in Australia permanently.

    Eligibility


    • You must be in a genuine and ongoing relationship with an Australian citizen, permanent resident or eligible New Zealand citizen.
    • You must meet certain health and character requirements.
    • You must provide sufficient evidence of the relationship and financial interdependence.

    Benefits


    • The 820 visa allows individuals to live and work in Australia temporarily, for a period of two years.
    • The 801 visa allows individuals to live and work in Australia permanently.
    • The holder of the 820 visa can apply for the 801 visa after two years if the relationship with their partner is still ongoing.
    • The holder of the 801 visa is eligible to apply for Australian citizenship after four years of permanent residency.
